The information provided in the property description, prospectus, and other informational material is mainly based on information provided by the seller. Some essential information is also obtained from the land registry. The real estate agent only verifies this information if circumstances warrant it. Buyers/prospective buyers are encouraged to verify this information as well as other matters relevant to the purchase of the property.
OBLIGATION TO INSPECT, ETC:
Basis for the allocation of responsibilities;
The starting point according to the Swedish Land Code is that the property should correspond to what has been agreed upon between the parties and should not deviate from what the buyer could reasonably expect at the time of purchase. In addition, it is understood that it is bought in the condition it is in on the date of the contract and that the buyer, to protect themselves, should conduct a thorough inspection of the property. For such defects or damages that the buyer had the opportunity to discover or should have anticipated due to the age and condition of the property, the seller cannot be held responsible. However, the seller is responsible for hidden defects, i.e., defects in the property that the buyer should not have discovered, regardless of whether the seller was aware of the defects or not. The seller's liability for hidden defects in the property applies for 10 years.
Buyer's inspection obligation:
The starting point is that the buyer must inspect the property, known as the buyer's inspection obligation. The requirements for the buyer's inspection are extensive. The property should be inspected in all its parts and functions. If possible, the buyer should also inspect attic spaces, crawl spaces, and other difficult-to-access areas. Special attention should be paid to moisture damage (especially in the basement and attic), rot damage, damage to water and sewage systems, cracks in the facade and foundation wall, and chimney stack. If the buyer discovers defects or symptoms of defects during the inspection, or if the property is in such a condition that defects can be suspected, the requirements for the buyer's inspection obligation are heightened. The information provided by the seller also affects the extent of the inspection obligation. For example, if the seller informs the buyer of a suspected defect, it can serve as a warning signal that should prompt a more thorough investigation by the buyer. On the other hand, the buyer should not have to inspect parts of the property for which the seller has provided explicit assurances or warranties, provided that these are not general in nature. The buyer should also consider that the seller is not liable for defects and shortcomings that the buyer should have anticipated considering the age, price, condition, and use of the property. Therefore, the buyer should adapt their inspection accordingly. When purchasing a used house, the buyer must consider that certain parts and functions have been subject to wear and tear and may need replacement or renovation due to age.
Engaging a surveyor:
The Swedish Land Code assumes that the buyer should be able to fulfill their basic inspection obligation on their own in most cases, and therefore it is not a requirement to engage a qualified expert for this purpose. Nevertheless, most buyers choose to engage a surveyor or other expert, which is recommended if they do not have specific building technical knowledge. The same applies if the buyer has initially inspected the property themselves and identified signs of defects that may be difficult to assess. As mentioned above, the buyer should inspect the property in all its parts and functions. Therefore, when engaging a surveyor, it is important to be aware of the scope of the inspection requested.
