DUTY TO INSPECT, ETC:

According to the Swedish Land Code, the property must correspond to what has been agreed upon between the parties and not deviate from what the buyer could reasonably expect at the time of purchase. The property must be inspected in all its parts and functions. If possible, the buyer must also inspect attic spaces, crawl spaces, and other difficult-to-access areas. Special attention should be given to moisture damage (especially in the basement and attic), rot damage, damages to water and sewage systems, cracks in the facade and foundation, and chimney stacks. If the buyer discovers defects or signs of defects during their inspection or if the property is in such a condition that defects can be suspected, the requirements for the buyer's inspection duty are heightened. The information provided by the seller also affects the extent of the inspection duty. If, for example, the seller informs the buyer about a suspected defect, it can serve as a warning that should prompt a more thorough inspection by the buyer. On the other hand, the buyer should not have to inspect parts of the property for which the seller has provided express assurances or warranties, provided that these are not too general. The buyer should also keep in mind that the seller is not responsible for defects and deficiencies that the buyer should have anticipated based on the age, price, condition, and use of the property. Therefore, the buyer should tailor their inspection accordingly. If the purchase involves a used house, the buyer must take into account that certain parts and functions may have undergone wear and tear and may need to be replaced or renovated due to age.
Engaging a building inspector
The Swedish Land Code assumes that the buyer should be able to fulfill their basic inspection duty on their own, and there is no requirement to engage an expert for this. However, most buyers choose to hire a building inspector or other expert, which is recommended if the buyer does not have specific building technical knowledge. The same applies if the buyer has initially inspected the property themselves and discovered signs of defects that are difficult to assess. As mentioned above, the buyer must inspect the property in all its parts and functions. Therefore, if the buyer engages an expert, it is important to pay attention to the scope of the inspection ordered. Typically, such an inspection does not cover certain parts of the property such as electrical installations, water and sewage systems, flues, etc., so the buyer should consider supplementing their inspection.
